Understanding your criminal charges in New York
Criminal charges in New York can be broadly categorized into three categories: a) violations, b) misdemeanors, and c) felonies.
Violations are the least severe charge, and technically not defined as a crime. The maximum imprisonment is 15 days. Common violations are harassment, unlawful possession of marijuana, exposing one’s private parts in a public place, drinking alcohol or being intoxicated in public, and public urination
Misdemeanors are the next most severe charge. The maximum term of imprisonment for ‘A-class’ misdemeanors is one year, and three years for ‘B-class’. Common examples of misdemeanors in New York are certain DWI offenses, shoplifting, certain forms of assault, and jumping a turnstile on the New York subway.
Felonies are the most severe criminal charge. There are five classes of felonies with A being the most serious and E the least serious. Felonies typically involve serious crimes such as murder, rape, sale of narcotics, and burglary.

If you’ve been arrested in New York, an arraignment in the Criminal Court of the City of New York will typically be arranged for you within 24 hours. You will be informed of the charges and bail if available. It is critical to call us BEFORE your arraignment takes place. The prosecutor will often try to intimidate you into pleading guilty or entering into one-sided plea bargains. Do not feel pressured or tempted into making any deal with the prosecution until you’ve spoken with an attorney!
